• 2.1 The WEBSITE https://www.piscinasbenalmadena.com (hereinafter the WEBSITE) is an online store whose objective is the sale of all products offered through the WEBSITE, as well as the search for the product requested by the CLIENT in the best conditions REDMALAGA locate.
• 2.2 The use of the WEBSITE implies the express and full acceptance of the conditions set forth herein, without prejudice to those individuals that may apply to some of the services offered by REDMALAGA.

4.1 ORDER MANAGEMENT

4.2 PRICE, METHOD OF PAYMENT, SECURITY IN PAYMENT
• 4.2.1. The prices indicated on the WEBSITE include the applicable taxes at all times. Transportation costs are detailed separately, unless otherwise stated.
• 4.2.2 The CLIENT may make the payment of the product purchased by means of payment that REDMALAGA makes available to the CLIENT.
• 4.2.3 In the case of payment by Bank Card, REDMALAGA may establish an additional cost to the amount of the order that will be specified where appropriate and will be informed to the CLIENT in the purchase process.
• 4.2.4 In case of bank transfer, the shipment of the product will begin once the payment is received in the REDMALAGA account. This circumstance will normally delay the order a day or two. If the transfer has not been made within five days, REDMALAGA will cancel the order.
• 4.2.5 REDMALAGA does not have access to bank data linked to these payment methods and does not know or record this data during the payment operation.
4.3 SHIPPING AND DELIVERY EXPENSES
• 4.3.1. The shipping costs of the order will be borne by the CLIENT.
• 4.3.2 Shipping costs will be free unless otherwise indicated on the product page. REDMALAGA will indicate the transport rates on the product page and in the ordering process, which must be approved by the CLIENT prior to the acceptance of the same.
• 4.3.3. REDMALAGA will inform the CLIENT of the delivery times of the order in the purchase process or, where appropriate, the supplier that supplies the order.
• 4.3.4 The delivery period will be as indicated on the page of each product, and will be between 1 and 30 working days.
• 4.3.5. It is up to the recipient to check the order at the time of delivery and then make all reservations and claims that the CLIENT deems justified.
4.4 WITHDRAWAL AND RETURN
• 4.4.1 The CUSTOMER may exercise the right of withdrawal during the FOURTEEN (14) business days following the date of delivery, in accordance with the provisions of current regulations on retail trade.
• 4.4.2 The CLIENT, to exercise the right of withdrawal, must express its willingness to return the product to the email address online@redmalaga.com, REDMALAGA will answer the CLIENT specifying the precise instructions to carry out the return of the same.
• 4.4.3 The expenses and risks related to the return of the product will be borne by the CUSTOMER, who must send them safely and with the necessary guarantees so that the returned merchandise arrives in perfect condition.
• 4.4.4 RED MALAGA reimburses the amount of the product, in the account indicated by the CLIENT within the period of SEVEN (7) days from the verification of the correct state of the goods.
• 4.4.5 REDMALAGA will only accept the return of the product when the use of the product has been limited to the mere verification of the proper functioning of said product by the CLIENT. Returns are not allowed if the product has been opened and its use has exceeded the mere verification of proper operation.
• 4.4.6. The return of the product will not be accepted if it is not returned in the same original packaging.
• 4.4.7 REDMALAGA will not accept the return of any product that suffers damage attributed by the CLIENT.
• 4.4.8. There is no refund in the case of perishable products, without prejudice to this, REDMALAGA will make available to the CLIENT an incident resolution channel.
4.5. DEFECTIVE PRODUCTS
• 4.5.1. If the product sent to the CUSTOMER is defective at source, REDMALAGA will respond to any breaches of conformity that appear within two years of the delivery of the product. The CUSTOMER must inform REDMALAGA of the lack of conformity within two months of becoming aware of it, within the two-year period set forth above.
• 5.1. REDMALAGA is the owner of the intellectual and industrial property rights, or has obtained the corresponding authorizations or licenses for its exploitation, associated with the domain name, trademarks and distinctive signs, application, information, computer programs and the rest of the works and inventions contained or related to this website and the technology associated with it.
